Albert Randall of Franklin & Prokopik led our discussion this morning on “Workers Compensation. What you can and cannot do”.

Bert stated that creating a company culture is key to success in handling workers compensation issues. Foster a culture of safety and compliance. One size does not fit all. Bert reminded us of the words of George Keeton. “Neither law nor human nature is an exact science”.

There are certain pre-injury steps that should be taken:

  • Designate a point person, a workers compensation administrator

  • Establish a reporting protocol

  • Train supervisory personnel

  • Disseminate policy to all employees

A workers compensation administrator must be familiar with the labor law minefield. Accurate job descriptions are a must. Learn to identify the red flags of fraud.

There is a three-way partnership of employer, third party administrator and defense counsel.
