Chairwoman Eileen Edwards introduced Jay Fries of
Kruchko & Fries to lead our employment law update.
Jay began with a review of the Fair Labor Standards Act
revisions, which became effective August 23, 2004. Some changes were
elimination of the long-term test and limits on required salary for
exemptions. The definition of an administrative employee was discussed
including the exercising of discretion and independent judgment. Salary
based compensation was defined and the effects of deductions from salary
were examined.
Jay then turned the discussion to affirmative action,
sexual harassment, the Maryland Wage Payment Law and the implications of
military personnel returning to work after serving.
