Chairwoman Christine Eichler welcomed a turnout of forty-eight members and guests. Christine introduced Jim Timmerman of member Miles & Stockbridge who introduced the team who led our discussion on Hot Topics in Employment Law.

Kirsten Eriksson presented some current issues of interest under the Fair Labor Standards Act. Computer professionals and overtime exemption, manager exemptions and primary duty definitions and hourly employee “on the clock” issues were discussed. Salary deductions including what you can and what you can not deduct were also discussed. Driving under the influence of work as related to cell phone use was certainly a hot topic.

Next, Gary Duvall covered a timely hot topic; military leave under USERRA and how returning servicepersons are protected.

Jim Timmerman followed with discussion on discovery in the age of electronics. Electronic documents such as email are playing a major role in the discovery process. Collecting these electronic documents becomes a very expensive process for those involved in litigation. Best advice is if you don’t need a document, get rid of it.
