Legislative Alert – Update by Jen Busse Esquire WTP Law

The Baltimore County Council passed Bill 41-22 Baltimore County MD (Notification of Development Fee Waiver) on July 5th, 2022

The bill codified how and when a developer can obtain a waiver from paying certain development fees. The law goes into effect in late August 2022 and may affect your business.

The process begins with a request to the County Administrative Officer who forwards notice of the request on to the County Council, Council Secretary and County Auditor. When the request is forwarded to the Council, it is posted on the County’s website for 45 days.

Within those 45 days, the Council may schedule the request for consideration at a legislative meeting. If no such request is made, then the County Administrative Officer may approve the fee waiver.

The law is silent on what exactly happens if and when a request for consideration at a legislative meeting is made, but presumably the Council will make a recommendation to the County Administrative Officer on the request.

The only criteria noted that apply to the County Administrative Officer’s consideration are 1) whether the Developer is a non-profit or for-profit and the project is funded by government resources or economic incentives; AND 2) whether the project is located in an economically disadvantaged community or an area targeted to benefit from community development block grant funds, OR and whether the project will positively impact the community’s health, well-being, quality of life, environment or overall sustainability.

Notably, Development Impact Fees are specifically excluded which arguably leaves decisions related to projects’ Development Impact Fees in the hands of the Director of Permits, Approvals & Inspections.


Hunt Valley Business Forum 2022–2023 SMART Goals and Priorities Public Policy Committee

PUBLIC SAFETY GOAL: To ensure the enforcement of current laws prohibiting panhandling.

TRANSPORTATION GOAL: To pursue specific highway and interstate interchange modifications to improve circulation and access in the greater Hunt Valley area.

LEGISLATIVE GOAL: To disseminate pertinent legislative issues to HVBF membership and community.

Since establishing these goals, Public Policy Committee members have been diligently working on identifying the appropriate channels and officials to help them meet the goals. In addition to meeting with Baltimore County police on numerous occasions and state highway officials, they are also engaging Baltimore County Executive and Council Members as well as appropriate leaders of community associations.

The next Public Policy Committee Meeting will be in September 2022.

April 20, 2022 at the HVBF Annual Meeting, Danielle Beyrodt, Chairperson for the Public Policy Committee, gave her enthusiastic update. She reported that in on January 26, 2022 the Public Policy Committee had a strategic planning meeting with area businesses, landlords and committee members to determine the 2022 SMART goals and priorities for public safety, transportation, and legislative categories. The goals decided upon are as follows.

PUBLIC SAFETY GOAL: To ensure the enforcement of current laws prohibiting panhandling.
