Public Policy Committee
Chair Danielle Bridge
Co-Chair Ashley Zito
Release Date August 30, 2022
Legislative Alert – Update by Ashley Zito and Jen Busse Esquire
The Baltimore County Council passed Bill 51-22 (Development- Review and Approval Process- Limited Exemptions) on August 1, 2022.
The Design Review Committee (DRC) , an inter-agency group comprised of department representatives, meets weekly to hear and recommend to the Director of Permits, Approvals & Inspections (“PAI”) requests for limited exemptions from the full development process. Exemptions from the full process relieve applicants from certain steps such as a Hearing Officer’s Hearing.
Bill 51-22 codified the general process for submitting an application to the DRC and established posting requirements for certain applications.
Specifically, applicants are now required to post, at their expense, for a period of 14 days and at least 7 days before the date of the DRC meeting, notice on the subject property of the date, time and place of the DRC meeting.
The same information is posted on the Department of PAI’s website.
Within 5 days of the issuance of the Director’s decision, the PAI shall also post notice of the approval or disapproval of the application to its website.
The notice shall include a written summary of the decision and the legal basis for granting or denying the exemption.
Although already the existing practice, the Bill codified that DRC meetings are open to the public for observation. And, while already codified in other sections of the County Code, the Bill made it clear that the Director’s decisions on DRC applications are appealable to the Board of Appeals.
