Time Sensitive Legislative Update: BUILDING ENERGY PERFORMANCE STANDARDS

The Climate Solutions Now Act of 2022 requires that the Maryland Department of Environment (MDE) develop “Building Energy Performance Standards” (BEPS). The MDE has announced its intent to post a draft of the BEPS for public comment beginning on May 15, 2023 and closing June 5, 2023.

The BEPS is a state-wide regulation that will require buildings 35,000 sq ft or larger (with some exceptions) to reduce direct greenhouse gas emissions 20% by January 1, 2030, and achieve net-zero direct emissions by January 1, 2040.

The draft regulations will be posted on the MDE BEPS website linked here.

Since establishing these goals, Public Policy Committee members have been diligently working on identifying the appropriate channels and officials to help them meet the goals. In addition to meeting with Baltimore County police on numerous occasions and state highway officials, they are also engaging Baltimore County Executive and Council Members as well as appropriate leaders of community association.

The next Public Policy Committee Meeting will be June 8, 2023

Maryland has enacted the most rigorous state law in the country reducing GHG emissions

The Climate Solutions Act 2022

With legislation that became law June 1, 2022, without the Governor’s signature, Maryland has enacted the most rigorous state law in the country reducing greenhouse gas (GHG) emissions and otherwise addressing ESG stewardship including climate change. Businesses can and should treat this as the greatest opportunity and responsibility of our time.

Literally resetting the trajectory of Maryland, making sweeping changes to the Old Line State’s already tough climate change laws, among other things.

Senate Bill 528 establishes new energy conservation mandates requiring that buildings, commercial or multifamily with a gross floor area of 35,000 square feet or more, except elementary and secondary school, must achieve a 20% reduction in net GHG emissions before January 1, 2030, a 40% GHG reduction before January 1, 2035 and be net zero before January 1, 2040.
